Welcome to PUPUK Academy. These Terms & Conditions govern your access to and use of the PUPUK Academy website, platform and associated services. By accessing or using the platform, you agree to these terms. If you do not agree, please discontinue using the platform.
1. About PUPUK Academy
PUPUK Academy operates an online educational marketplace that connects students, parents and independent tutors and provides access to educational learning materials and related resources.
Our services may include tutor discovery and profile listings; opportunities for independent tutors to showcase their services; educational notes, worksheets, practice materials and digital resources; paid memberships and subscription-based access to selected learning materials; and platform services that facilitate connections between tutors and prospective students.
2. Eligibility and User Accounts
Users must provide accurate, complete and current information when registering or using the platform. Users are responsible for maintaining the confidentiality of their account credentials, ensuring submitted information is accurate, activities conducted through their accounts, and notifying us of suspected unauthorised access.
Where a user is below the age of 18, registration, purchases and tutoring arrangements should be made or supervised by a parent or legal guardian.
3. Independent Tutors and Tutoring Services
PUPUK Academy provides a platform for independent tutors to showcase their profiles and connect with prospective students.
Tutors operate independently and are not employees, agents, partners or representatives of PUPUK Academy. Tutors are responsible for their own qualifications, credentials, teaching methods, lesson arrangements and professional conduct. Tutors independently determine their tutoring fees, schedules, availability and service arrangements.
Students and parents are responsible for assessing the suitability of tutors before entering into tutoring arrangements. PUPUK Academy does not guarantee tutor availability, student enquiries, academic improvement or specific learning outcomes.
Students and parents are encouraged to verify a tutor's qualifications, experience, suitability and references before engaging their services. Any tutoring agreement entered into is primarily between the independent tutor and the student or parent.
4. Tutor Service Fees and Platform Commission
In consideration of the platform's services, PUPUK Academy may charge tutors a service fee or commission for tutoring engagements facilitated through the platform.
The applicable service fee or commission rate will be communicated to tutors before they participate in the relevant arrangement. The service fee may be calculated as a percentage of the tutoring transaction or according to another agreed fee structure.
Where applicable, the service fee may be deducted from tutoring payments before the remaining amount is paid to the tutor. Tutors are responsible for reviewing and agreeing to the applicable fee structure before accepting tutoring engagements.
Any applicable payment processing charges, taxes or additional deductions will be disclosed where relevant. PUPUK Academy may revise its service fee structure with reasonable prior notification.
Tutors agree not to deliberately circumvent applicable platform service fees by moving engagements originating through PUPUK Academy outside the platform for the purpose of avoiding agreed fees.
The collection of a platform service fee does not, by itself, establish an employment relationship, partnership or agency relationship between PUPUK Academy and independent tutors.
5. Tutor Responsibilities
Tutors agree to provide accurate information about their qualifications and experience; ensure profiles and subject descriptions are not misleading; maintain professional and appropriate conduct; respect students' privacy and confidentiality; obtain appropriate parental or guardian involvement when dealing with minors; honour tutoring arrangements agreed with students or parents; and comply with applicable laws and agreed platform service fee arrangements.
Tutors must not submit false credentials, impersonate other individuals or engage in fraudulent, discriminatory, abusive or inappropriate conduct. PUPUK Academy may review, restrict, suspend or remove tutor profiles that violate these terms.
6. Learning Materials and Intellectual Property
Educational materials made available through PUPUK Academy, including notes, worksheets, graphics, documents, designs, branding and digital resources, are protected by applicable intellectual property laws. Unless expressly stated otherwise, these materials are provided for personal educational and non-commercial use.
Users must not reproduce or redistribute materials without permission; resell or commercially exploit educational resources; share paid membership access with unauthorised individuals; remove copyright notices or ownership information; or copy, modify or distribute platform content without appropriate authorisation.
Tutors and other contributors retain ownership of their original content, subject to any licence granted to PUPUK Academy to display, distribute or operate that content through the platform.
7. Memberships and Payments
PUPUK Academy may offer paid memberships providing access to selected educational materials. The learning-materials membership is currently offered at RM20 per month, subject to the subscription terms displayed at the time of purchase.
Membership access is subject to successful payment. Subscription periods and renewal arrangements will be disclosed during purchase. Where a membership is set to renew automatically, PUPUK Academy will send a renewal reminder to the email address registered to the member's account at least 7 days before the scheduled renewal date. Users are responsible for keeping their email address current and checking their inbox (including spam or junk folders). Users should cancel before the next renewal date if they do not wish to continue. Membership benefits may differ depending on the selected plan. Sharing account credentials or membership access with unauthorised users is prohibited.
Cancellation and refund arrangements are governed by the Refund & Cancellation Policy.
8. Third-Party Services and External Links
The platform may contain links to third-party websites, payment providers, communication services or other external platforms. These services operate under their own terms and privacy policies. Pupuk Education is not responsible for the content, availability, security or practices of external websites and services.
9. Acceptable Use
Users must not use the platform for unlawful or fraudulent purposes; upload malicious software or harmful content; misrepresent their identity or qualifications; harass, threaten or exploit other users; attempt to access restricted areas or other users' accounts; interfere with platform security or functionality; scrape, copy or commercially exploit platform information without permission; or misuse the platform to avoid agreed service fees.
10. Suspension and Termination
PUPUK Academy may restrict, suspend or terminate accounts or access to services where users violate these terms, submit misleading or fraudulent information, engage in abusive or unlawful activities, misuse educational materials, fail to comply with agreed platform fee arrangements, or compromise platform security or other users' safety. Where reasonably practicable, users will be notified of significant account restrictions.
11. Platform Availability
We aim to maintain a reliable and accessible platform but do not guarantee uninterrupted availability. Access may occasionally be affected by maintenance, technical issues, security updates or circumstances beyond our reasonable control.
12. Limitation of Liability
To the extent permitted by applicable law, PUPUK Academy shall not be liable for disputes arising from independently arranged tutoring services; differences in teaching approaches or academic outcomes; inaccurate information submitted by users or independent tutors; interruptions caused by third-party services; or unauthorised use of accounts resulting from users' failure to protect their credentials.
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
13. Privacy
Personal information submitted through the platform is handled in accordance with our Privacy Policy and applicable data protection requirements.
14. Changes to These Terms
PUPUK Academy may update these Terms & Conditions to reflect changes in services, platform features or legal requirements. Updated terms will be published on this page with a revised effective date.
15. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the jurisdiction of the competent courts in India.
